General Information
1.1 The Culture at COP website is managed and maintained by Museums Galleries Scotland, a charity registered in Scotland under charity number SC015593 and a private company limited by guarantee registered under company number SC074264, having its registered/principal office at Waverley Gate, 2-4 Waterloo Place, Edinburgh, EH1 3EG (“MGS”).
1.2 The Culture at COP website is maintained for your personal use and viewing. Access and use by you of the Culture at COP website constitutes acceptance by you of these Terms and Conditions which take effect from the date of first use.
Content of Listed Events
2.1 Events must be carried out as per the details included at the point of registration. Any changes to the event must be flagged to MGS immediately, by contacting climate@museumsgalleriesscotland.org.uk.
2.2 The main activity of listed events must consist of COP26-themed art, culture and heritage activity which must adhere to one or more of the primary and secondary categories as set out in the Event Form. This must be clearly demonstrated in the “Event Description” section of the Event Form.
Event Organisers’ Obligations
3.1 Each organisation registering an event must provide contact details for a member of the organisation who will be available throughout the period from the point of registering the event to the completion of the event (“key contact”). Should there be any change in key contact, MGS must be informed immediately.
3.2 Where an event is cancelled, the organisation must inform MGS immediately, including an explanation for the cancellation.
Events Moderation
4.1 Culture at COP website moderators (“moderators”) reserve the right to remove or refuse an event listing which:
- Is not clearly linked to climate and COP26-related art, culture and heritage activity;
- Cannot be independently verified;
- Condones, encourages, incites or necessitates illegal or irresponsible activity;
- Condones, encourages, incites or necessitates offensive behaviours or attitudes, including violence, racism, sexism, homophobia, biphobia, transphobia heterosexism, xenophobia, hate speech and ableism;
- Serves to provide a platform for organisations or activities which work against the objectives of COP26 (as set out at HOME - UN Climate Change Conference (COP26) at the SEC – Glasgow 2021 (ukcop26.org); and
- Is, at the discretion of the moderators, to be otherwise considered unsuitable for the Culture at COP website.
Liability
5.1 MGS provides event listings on the Culture at COP website in good faith and endeavours to ensure that the content is accurate, complete and up to date. Although care has been taken in preparing the information contained on this site, MGS does not guarantee its accuracy, and MGS is not responsible for any errors or omissions or for any loss or damage suffered by users of any of the information published on the Culture at COP website.
5.2 All information on the Culture at COP website is provided 'as is', with no guarantee of completeness, accuracy or timeliness or of the results obtained from the use of this information, and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
5.3 MGS does not warrant that functions contained in the material contained in the Culture at COP website will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or represent the full functionality, accuracy, reliability of the materials. In no event will MGS be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damages whatsoever arising from use or loss of use of, data or profits arising out of or in connection with the use of the Culture at COP website.
5.4 All events are the responsibility of the organisation which has registered the event on the Culture at COP website (“event organisers”). Unless otherwise stated, MGS is not responsible for any event listed on this site. MGS does not accept liability for activity during, or as a result of, any listed event, including talks and workshops.
5.5 MGS shall not be liable for any claim arising out of or referable to the actions of event organisers or those of an event organiser’s agents or contractors in holding an event listed on the Culture at COP website.
Privacy
6.1 Any information of a confidential nature which is communicated to MGS by an event organiser will be treated as confidential unless, in MGS’s discretion, there is a legitimate reason for its disclosure, such as an indication of illegal activity. Use of Data
7.1 Any contact data provided to MGS by event organisers will be held according to MGS’s Data Retention Policy.
7.2 MGS reminds Culture at COP website users that contact data relating to event organisers published on this site must not be used to compile addresses for marketing products or services. However, MGS cannot be held responsible for any third party use of data which event organisers have agreed to publish on the site.
7.3 When you enter the Culture At COP website your computers will automatically be issued with 'cookies'. Cookies are text files which identify your computer to Culture At COP's server. The website then creates "session" cookies to store some of your preferences moving around the website, e.g. retaining a text-only preference. Cookies in themselves do not identify individual users but identify only the computer used and they are deleted on departure from the website. Many websites do this to track traffic flows, whenever users visit those websites. You have the opportunity to set your computers to accept all cookies, to notify you when a cookie is issued, or not to receive cookies at any time. Images
8.1 The event form requires the upload of images to the site for each event. If an image is not supplied MGS reserves the right to use an appropriate licensed image of their choosing.
8.2 If you are submitting an image for the site, please attach relevant copyright information as part of the file upload. MGS will publish your copyright information but does not take any responsibility for any copyright infringement arising from your use of this site.
Disputes
9.1 In the event of any dispute arising out of these terms and conditions, MGS will refer the decision to a mutually agreed arbiter whose decision shall be final and binding on the event organiser and MGS.
9.2 Event organisers registering an event on the Culture at COP website agree to submit to the exclusive jurisdiction of the Scottish Courts in any action arising out of a dispute.
